These Terms of Service ("Terms") govern your access to and use of LeadTrackAI's AI-powered lead qualification platform and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
Acceptance of Terms
By creating an account, accessing our platform, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.
These Terms constitute a legally binding agreement between you (either an individual or an entity) and LeadTrackAI. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
Description of Services
LeadTrackAI provides:
- AI-powered conversational lead qualification via Voice, SMS, and Email
- Lead scoring and analytics dashboards
- Integration with CRM and business systems
- Industry-specific solutions for solar, automotive, and real estate sectors
- Customer support and training resources
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
Account Registration and Security
To use our Services, you must:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access or security breach
- Be at least 18 years old or the age of majority in your jurisdiction
You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.
User Obligations and Acceptable Use
You agree not to:
- Use the Services for any illegal or unauthorized purpose
- Violate any applicable laws, regulations, or third-party rights
- Upload or transmit viruses, malware, or other malicious code
- Attempt to gain unauthorized access to our systems or networks
- Interfere with or disrupt the Services or servers
- Use automated systems to access the Services without permission
- Reverse engineer, decompile, or disassemble any part of the Services
- Remove or modify any proprietary notices or labels
- Use the Services to spam, harass, or send unsolicited communications
- Impersonate any person or entity or misrepresent your affiliation
Compliance with Australian Laws
You must comply with all applicable Australian laws, including the Privacy Act 1988, Spam Act 2003, and Do Not Call Register Act 2006 when using our Services to contact leads.
Payment Terms
Subscription Fees
Access to the Services requires payment of subscription fees as described in your selected plan. All fees are in Australian Dollars (AUD) unless otherwise stated.
Billing
- Subscription fees are billed in advance on a monthly or annual basis
- You authorize us to charge your payment method on file
- Fees are non-refundable except as required by law
- We may change our fees with 30 days' notice
- Failure to pay may result in suspension or termination of your account
Free Trials
We may offer free trials for new users. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.
Intellectual Property Rights
Our Rights
The Services, including all content, features, functionality, software, and technology, are owned by LeadTrackAI and are protected by Australian and international copyright, trademark, patent, and other intellectual property laws.
Your Rights
You retain all rights to your data and content. By using our Services, you grant us a limited license to use, store, and process your data solely to provide the Services and improve our AI models (using anonymized data).
Data and Privacy
Your use of the Services is also governed by our Privacy Policy. We process your data in accordance with the Australian Privacy Principles and applicable data protection laws. You are responsible for ensuring you have the necessary rights and consents to provide lead data to our platform.
Warranties and Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Services will be uninterrupted, secure, or error-free
- The results obtained from using the Services will be accurate or reliable
- Any errors in the Services will be corrected
- The AI models will produce specific results or outcomes
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEADTRACKAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability to you for all claims arising from or relating to the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless LeadTrackAI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another party
- Your data or content provided to the Services
Termination
By You
You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of your current billing period.
By Us
We may suspend or terminate your access to the Services immediately, without prior notice, if you breach these Terms or engage in fraudulent or illegal activities.
Effect of Termination
Upon termination, your right to use the Services will immediately cease. We will provide you with the ability to export your data for 30 days after termination, after which your data may be deleted.
Governing Law and Dispute Resolution
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
Before initiating any legal proceedings, you agree to first attempt to resolve the dispute through good faith negotiations with us.
Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the modified Terms.
General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and LeadTrackAI regarding the Services.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
